The trust shield is defeated by evidence that&nbsp; the settlor retained practical control over the trust assets in ways that are inconsistent with genuine&nbsp; title transfer.&nbsp;<\/p>\n\n\n\n<p class=\"has-large-font-size\"><strong>The Exemption Shield: Statutory Floor Protection&nbsp;<\/strong><\/p>\n\n\n\n<p>The exemption shield provides a floor of creditor protection that is available regardless of the&nbsp; timing of the protective arrangement and regardless of the governance quality of the structural&nbsp; shields.
